Terms of service
Version: October 19, 2026
These Terms govern all services provided by Adam Šejna, a sole trader trading as AnimationsFast, registered in the Czech Trade Register, Company ID (IČO) 24967050, address K Dolům 2, Prague 4, Czech Republic, email info@animationsfast.com ("we", "us"), to the business that orders them ("Client", "you").
1. Business customers only
Our services are offered only to businesses and professionals acting for business purposes. By ordering, you confirm that you are not a consumer. Consumer protection rules that apply only to consumers (including withdrawal rights) therefore do not apply.
2. How a project is agreed
2.1 Each project is defined in a written quote or proposal (the "Order") that states the scope, deliverables, formats, length, number of revision rounds, price, and delivery timeline.
2.2 The Order becomes binding when you confirm it in writing and we receive the deposit. If the Order and these Terms conflict, the Order wins.
2.3 Your own purchase-order terms do not apply unless we sign them.
3. Prices and payment
3.1 Prices are in US dollars and exclude any taxes, bank fees, and third-party costs (stock footage, music, fonts, voice-over) unless the Order says otherwise.
3.2 Deposit. 50% of the price is due before work starts. For projects under $1,000, or pilot projects, 100% is due upfront. The balance is due before we release final, unwatermarked files. Section 4.2(e) overrides this section where it applies.
3.3 Retainers are billed monthly in advance. Unused hours or credits do not roll over.
3.4 Invoices are payable within 7 days. Late amounts bear interest at 1% per month (or the maximum allowed by law, if lower). We may pause work while an invoice is overdue.
3.5 You pay your own bank and transfer fees, so we receive the full invoiced amount.
3.6 Each invoice states how VAT or any similar tax applies to it.
4. Timelines
4.1 Custom-priced work. For YouTube animation retainers, monthly motion retainers and the dedicated external animator, delivery times are set in the Order. They run from the moment we have both the payment due under section 3 and the materials listed in the Order (logos, copy, product images, brand guidelines).
4.2 24-hour delivery guarantee.
(a) Scope. This guarantee applies to every fixed-price project: logo animation, ad animation, product and UI animation, launch videos, explainer videos, website and Lottie animation, and pilot projects, for the scope stated in the Order. It does not apply to the custom-priced work in section 4.1.
(b) Start. The 24-hour period starts when both of these are true: (i) the payment due before work starts under section 3.2 has arrived in our account; and (ii) you have approved in writing (email is enough): the brief, for projects without a script; the script, for projects that tell a story or have narration; or the script and the recorded voiceover, for explainer videos with professional voiceover. We confirm the start time by email.
(c) What we deliver. Within 24 hours we deliver the complete video at final quality: fully designed and animated, with music and sound, at final resolution, in the scope stated in the Order. It may be watermarked under section 7.2. An animatic, storyboard, sketch or partial video does not count as delivery. Delivery happens when we send you the download or review link by email.
(d) Revisions. Each included revision round is delivered within 24 hours after we receive your consolidated list of changes under section 5.1.
(e) If we are late. If we miss a deadline under (c) or (d) for reasons within our control, you owe nothing for that project. We refund all amounts you paid for it in full within 14 days, finish the project including the remaining included revision rounds, and the rights under section 7.1 pass to you as if you had paid in full. This is your sole remedy for late delivery.
(f) Exclusions. The 24-hour period is extended by any time during which: (i) we are waiting for your feedback, approvals, answers, or materials listed in the Order, or materials you send are incomplete or unusable; (ii) you request a change of scope under section 5.2, in which case the changed work is quoted separately and receives its own 24-hour deadline once approved and paid; or (iii) a force majeure event under section 11 prevents the work. We tell you in writing when the period is paused and when it resumes.
4.3 Your delays (late feedback, missing materials, scope changes) move every timeline accordingly. If a project is on hold for more than 30 days because we are waiting on you, we may invoice the work completed so far and close the project.
5. Revisions and changes
5.1 Each Order includes a set number of revision rounds: two on fixed-price projects other than pilots, one on pilot projects and on YouTube episodes, unless the Order says otherwise. A revision round is one consolidated list of changes to the current version. Small fixes such as typos or color swaps do not count as a round.
5.2 Changes outside the approved brief (new script, new style, new formats, extra length) are a change of scope and are quoted separately before we do them.
5.3 If you do not respond to a final version within 10 business days, it is treated as approved.
6. Cancellation and refunds
6.1 You may cancel a project at any time by email.
6.2 The deposit covers booked production time and is non-refundable once work has started, except as set out in section 4.2(e). If you cancel before we start work, we refund the deposit minus 10% for administration.
6.3 If you cancel after work has started, you pay for work done up to that point, at least the deposit. Rights in unfinished work pass to you only once that amount is paid.
6.4 If we cannot complete the project for reasons on our side, we refund all amounts paid for the undelivered part.
6.5 Retainers can be paused or cancelled by email before the next billing date. The change takes effect at the end of the month already paid, unless the Order sets a longer notice period.
6.6 Dissatisfaction with a creative style that matches the approved brief and drafts is not a reason for a refund. We will use the included revision rounds to get it right.
7. Intellectual property
7.1 Final deliverables. Once you have paid in full, we grant you, to the maximum extent permitted by applicable law, all economic rights in the final deliverables, as follows: to the extent the law allows a transfer, we assign those rights to you; to the extent it does not (for example, Czech copyright law does not allow economic rights to be transferred), we grant you an exclusive, worldwide, perpetual, irrevocable, transferable and sublicensable licence to use, copy, modify, publish, and distribute the final deliverables in any media, without further payment.
7.2 Before full payment, you may only review drafts. Drafts may be watermarked.
7.3 Our tools and know-how. We keep ownership of our pre-existing materials, templates, code, rigs, project file structures, generic motion presets, and techniques. Where they are embedded in a deliverable, you receive a non-exclusive, perpetual licence to use them as part of that deliverable.
7.4 Project source files (After Effects, Blender, Remotion, etc.) are not included unless the Order says so. They can be purchased separately.
7.5 Third-party assets. Stock footage, music, fonts, and other licensed materials remain subject to their providers' licences. We will tell you which ones we used. If a licence requires the end user to buy it or limits usage (for example, paid ads or broadcast), we will tell you before using it, and you are responsible for complying with it after delivery.
7.6 Your materials. You confirm that you own or have the right to use everything you send us (logos, product images, music, copy, trademarks, people's likenesses), and you grant us a licence to use them only to do the project. You will defend and indemnify us against claims arising from your materials or from claims made in content you approved (for example, product or health claims).
7.7 Moral rights. To the extent permitted by law, we agree not to assert moral rights in a way that prevents your normal use, editing, or adaptation of the final deliverables.
7.8 Portfolio. We may show the final work in our portfolio and showreel after it is publicly released by you, unless you ask us not to in writing before the project starts, or the work is covered by a non-disclosure agreement.
8. Confidentiality
Each party keeps the other's non-public business information confidential and uses it only for the project. This does not apply to information that is public, already known, or required to be disclosed by law. This obligation lasts 3 years after the project ends.
9. AI tools
We may use software tools, including AI-assisted tools, as part of our production process. We remain responsible for the deliverables. We will not upload your confidential materials to AI services that use customer inputs to train their models. If you do not want AI-assisted tools used on your project, this must be stated in the Order.
10. Warranties and liability
10.1 We will perform the services with reasonable skill and care and deliver work that substantially matches the approved brief.
10.2 Except as stated in these Terms, the services are provided without any other warranties, including fitness for a particular purpose or that the work will achieve particular business results (views, sales, conversions).
10.3 Liability cap. Our total liability under or in connection with each Order is limited to the amount you paid us for that Order.
10.4 Neither party is liable for indirect or consequential losses, including lost profits, lost revenue, or lost data.
10.5 Nothing in these Terms limits liability that cannot be limited by law, including liability for intentional misconduct or gross negligence.
10.6 You are responsible for checking the final deliverables before publishing them, including legal claims, spelling, prices, and compliance with advertising rules in your markets.
11. Force majeure
Neither party is liable for delays caused by events beyond its reasonable control (illness, power or internet outages, hardware failure despite reasonable backups, acts of government). The affected party will notify the other promptly, and deadlines move accordingly.
12. Independent contractor
We are an independent contractor. Nothing in these Terms creates an employment, partnership, or agency relationship. We may use vetted subcontractors and remain responsible for their work.
13. Governing law and disputes
13.1 These Terms and each Order are governed by the laws of the Czech Republic, excluding its conflict-of-law rules. The UN Convention on Contracts for the International Sale of Goods (CISG) does not apply.
13.2 The parties will first try to resolve any dispute by good-faith discussion for 30 days.
13.3 If that fails, disputes will be decided by the competent courts of Prague, Czech Republic.
14. General
14.1 These Terms and the Order are the entire agreement for the project.
14.2 Changes must be agreed in writing (email is sufficient).
14.3 If any provision is invalid, the rest stays in force.
14.4 We may update these Terms for future Orders. The version that applies to an Order is the one referenced when that Order was confirmed.
14.5 Notices are sent by email to the addresses used in the Order.
